These Terms of Service ("Terms") govern your access to and use of our website, pipeline estimation tools, and downloadable concept art, 3D character base meshes, and neural audio assets (collectively, the "Services").

By accessing or using our Services, submitting your contact details to receive our free developer toolkit, or downloading asset files, you signify that you have read, understood, and agree to be bound by these Terms.

1. Nature of the Services & 100% Free Lead Magnet Model

CandyFiction Club functions as a pre-production research laboratory and concept engineering platform for game developers, technical animators, and concept artists.

• No Hidden Fees or Subscriptions: All resource packages promoted through our primary lead generation channels are delivered 100% free of charge. There are no mandatory charges, recurring billing cycles, or paywalls required to access our starter toolkit.
• Lead Magnet Exchange: In exchange for instant access to our downloadable toolkits, base meshes, and audio packages, you provide valid contact information (name, work email, phone number) allowing us to transmit delivery credentials and technical developer notifications.

2. Permissive Asset License & Usage Rights

Unless explicitly stated otherwise in an accompanying license file, all 3D base meshes, procedural shader graphs, and neural voice audio files delivered via our starter developer kit are granted to you under a worldwide, perpetual, royalty-free, non-exclusive commercial developer license:

• Permitted Uses: You may incorporate, modify, sculpt, re-texture, bake, and integrate the asset models into commercial or non-commercial video games, interactive applications, cinematic trailers, pitch decks, virtual productions, and software titles.
• Prohibited Uses: You may NOT sub-license, resell, redistribute, or package our base asset files as standalone 3D stock models, raw geometry libraries, or sound effect packs on third-party digital marketplaces (e.g., Unity Asset Store, Fab, TurboSquid).

3. Accuracy of User Information

When submitting inquiry or download request forms, you represent and warrant that all information provided (including your name, email address, and telephone number) is authentic, accurate, and current. Submitting deceptive, fraudulent, or automated bot inputs is strictly prohibited and grounds for immediate blocking.

4. Interactive Pipeline Estimator Disclaimers

The pipeline savings calculations, hours saved figures, and render benchmark estimates generated by our online interactive tool are provided solely for indicative and planning purposes. Actual production velocity and rendering speedups depend on individual studio hardware architectures, engine versions (Unreal Engine 5 / Unity), poly-count constraints, and human pipeline variations.

5. Intellectual Property & Trademarks

The trademarks, service marks, logo designs, custom web interface code, and brand visual identity of "CandyFiction Club" and "CandyFiction Creative Lab" are the proprietary property of CandyFiction Creative Lab LLC. Nothing in these Terms grants you ownership rights to the CandyFiction Club brand marks or software interface code.

6. Warranty Disclaimer ("AS IS")

THE SERVICES, ASSET PACKAGES, 3D TOPOLOGY SCALINGS, AND NEURAL AUDIO FILES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, CANDYFICTION CREATIVE LAB LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7. Limitation of Liability

IN NO EVENT SHALL CANDYFICTION CREATIVE LAB LLC, ITS DIRECTORS, EMPLOYEES, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF GAME DATA, ENGINE CRASHES, PROJECT DELAYS, OR LOSS OF ANTICIPATED PROFITS) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE OUR SERVICES OR ASSETS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8. Governing Law & Jurisdiction

These Terms and any disputes arising out of or related to your use of the Services shall be governed by and construed in accordance with the laws of the State of Texas, United States, without giving effect to any principles of conflicts of law. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Travis County, Austin, Texas.
